1. Request letter from the existing Assignee (Assignor) for transfer of unit to the new Assignee (Assignee).
2. Physical presence of both parties at M/s. ETA Star Property Developer LLC Office for execution of Assignment Form by both the Assignor and the Assignee.
3. In the event that the Assignor or Assignee is unable to present at the time of Assignment, their Representative should possess an original, valid Power of Attorney, duly attested by a Notary Public of the country of domicile of the Assignor, the Ministry of Foreign Affairs of the same country, and the UAE Embassy in that country. In the absence of a UAE Embassy, the attestation of the Embassy of any GCC country would suffice. Further the document has to be attested at the Foreign Affairs in Dubai. In the event of a Power of Attorney being drawn up in Dubai, attestation by the Dubai Court is required.
4. In case of any Mortgage over the unit in the name of Assignor, the Lien release letter in original has to be submitted.
5. The Assignment Agreement & the related forms should be signed by both the parties.
6. Original Reservation Form and original Receipts issued to the Assignor to be returned to M/s. ETA Star Property Developer LLC.
7. Original Sale Agreements, issued to the Assignor to be returned to M/s. ETA Star Property Developer LLC.
8. AED 5,000/- towards Administration charges to be paid to M/s. ETA Star Property Developer LLC.
9. Initial Oqood charges of AED 1000/- be paid by the Assignor to M/s. ETA Star Property Developer LLC.
10. Initial Oqood charges of AED 1000/- to be paid by the Assignee to M/s. ETA Star Property Developer LLC.
11. 2% Registration charges to be paid by the Assignor (1% on the Original Price & 1% on the New Sale Price) to Dubai Lands Department.
12. 1% Registration charges to be paid by the Assignee (1% on the New Sale Price) to Dubai Lands Department.
13. The Assignee should pay 50% of the next installment to M/s. ETA Star Property Developer LLC.
14. The Passport copy of the Assignor & Assignee to be given to M/s. ETA Star Property Developer LLC.
15. All outstanding amounts to M/s. ETA Star Property Developer LLC should be cleared before the transfer of Unit. In case of any late payments, the interest charges for the same should be cleared before the transfer of the Unit.
16. At the time of transfer, the Assignor's account across projects will be checked. If the Assignor has a balance due in any project with M/s. ETA Star Property Developers LLC, he will not be permitted to resell unless all his balances including interest on delayed payment are settled. If the Assignor pays by personal cheque, a period of 3 days is required until the cheque clears before he is permitted to resell.
17. Any Transfer is subject to the approval of Lands Department.
18. As and when intimated by ETA Star Property Developers LLC the Assignor & Assignee shall be present at Dubai Lands Department, to sign the required documents.
19. Receipt shall be issued only after the approval from Dubai Lands Department.
20. On approval of the Transfer from Dubai Lands Department, one copy each of the original Transfer Agreement shall be send to the Assignor and Assignee.
Note:Any transfer will be considered void unless all required documents are signed and all payments are made. M/s. ETA Star Property Developers LLC shall not be responsible for any purchase or transfer done outside its sales offices.
